Structure of the regulation: risk-based approach, obligations tied to roles rather than technologies. What the text defines as an AI system (Art. 3) and where the boundary lies with conventional software. Territorial scope and exclusions (Art. 2): national security and defence, scientific research and development, personal non-professional use, open-source components under conditions. The four roles and their respective obligations, then the shifts under Art. 25: affixing a trademark, substantially modifying a system or diverting its intended purpose turns the deployer into a provider. Prohibited practices (Art. 5): social scoring, exploitation of vulnerabilities, emotion recognition in the workplace and education, untargeted scraping of facial images, real-time remote biometric identification and its derogations. Workshop: qualifying ten real use cases brought by participants.
The two entry points to high-risk: systems that are a product or safety component covered by the harmonisation legislation in Annex I (Art. 6(1)), and the eight domains in Annex III (biometrics, critical infrastructure, education, employment and worker management, access to essential services including creditworthiness and life/health insurance pricing, law enforcement, migration and border control, justice and democratic processes). The derogation in Art. 6(3) and the obligation to document its assessment before deployment. Systems subject only to the transparency obligations of Art. 50. General-purpose AI models integrated into an application chain and the implications for downstream users. Workshop: build a classification decision tree, apply it to a typical organisation’s portfolio, then arbitrate edge cases as a group.
Create an actionable AI inventory: purpose, business owner, provider, data processed, role assumed, classification and justification, lifecycle status, criticality. Automatically derive the list of applicable obligations for each system from its classification. Link the inventory to the GDPR processing register, application mapping and procurement process without maintaining three parallel repositories. Keep the inventory alive: entry point for any new tool, detection of undeclared AI uses, periodic review, arbitration of doubtful cases. Running case: produce an organisation’s inventory, a prioritised compliance roadmap and the governance structure that supports it.
